Decree No. 202/2013/ND-CP: Tougher rules on fertilizer production

Accordingly, from February 1, 2014, in addition to having business registration certificates or certificates of investment in production and trading of fertilizers granted by competent state agencies; having suitable machinery, equipment and technological processes for production output and types of fertilizers, fertilizers producers must also introduce and apply standards on input materials in conformity with conditions for control of fertilizer product quality; and fertilizer quality-analyzing and -testing sections.

Their managerial, technical and operational staffs must be qualified and knowledgeable in chemical, physical and biological fields.

The new regulation also details conditions for fertilizer trading applicable to organizations and individuals. Specifically, they must have certificates of registration for certificate business; meet all the prescribed conditions on fire prevention and fighting, environmental protection, labor safety and sanitation; and have warehouses for storing fertilizers so as to ensure quality and environmental sanitation, etc.

After two years from the effective date of this regulation, organizations and individuals that produce and trade in fertilizers must terminate their operations if they fail to fully satisfy or additionally satisfy the above conditions and standards.

This Decree will replace Government Decrees No. 113/2003/ND-CP of October 7, 2003, and No. 191/2007/ND-CP of December 31, 2007.-
